FOIA Law as related to charter schools:
3. Public Records
In general, charter schools must provide any record, including data files, letters, memoranda or other documentary materials made or received by an officer or employee of the school, to any member of the public who requests it. See G.L. C. 4, §7 (26); G.L. c. 66. The law lists specific exemptions that protect the confidentiality of certain records. For example, if the information pertains to an individually identifiable student, then the school may be restricted from providing the information. See the section of this Guide that covers Student Records for more information regarding records that relate to students.

Some of the more 'Recommended' comments in response to MVRCS published letter to the Globe.
We have provided these comments and discussions as a means of sharing some public, unconfirmed (yet concerning if true) postings regarding MVRCS. A concern we have (and part of why we have chosen to preserve the discussions) is the number of posts that have been removed. As several of us have followed this discussion for some time (and where able to read the posts before they were deleted), and did not feel the information was in violation of guidelines of Boston.com. The question has been asked why the posts were deleted and who requested it.
The posts and discussions below are extension (and entertaining at points) and can be difficult to follow. Please know that we have made note of pertinent information and will incorporate it into our blogs. Thank you.

It was appalling for us to see how much they got away with when under-reporting to the DOE. When these facts were pointed out to the DOE, they said that they had to go with what the school reported to them, because, they were understaffed and could not verify the reports that were being given to them.
One thing that most people do not realize, this school receives state and federal dollars. If they report how many students honestly left, that would mean less money for them. Same thing with children with learning disabilities ~ if a child with a disability leaves the school that is separate money from both state and federal, so if that child leaves, the money stops for that child. It’s as simple as that.
For parents who are new to this school, protect it all that you want, but listen before jumping in. You are new to this, so of course you want to protect it, but sadly for those parents who had children in this school (the first graduating class), and it was a nightmare. The administration must be thrilled that those parents are gone! Those were the parents who kept a watchful eye on the administration. Now they can get away with anything that they want to, because the parents’ who bought into “this is your school” at the very beginning, were immediately put into their places by a single dictator who made it clear that he and only he, ran the show – those parents are all gone.
I don’t know of any parent who left this school because of the teachers. If anything, they were disgusted by the incredible huge teacher turnover, not to mention the student turnover. The teachers were never a problem for the parents, the teachers were only a problem for the Board of Trustees and the head office, who demanded that all teachers be puppets-on-a-string. If they weren’t, they were axed.
I will end this by asking the Boston Globe why they started their investigation, and then abruptly ended it by removing their story that they originally wrote. I hope that the politically connected did not get to you.

As a charter school parent I think the school gave way too much to the city for way too little in return. The fire station was to have been vacated or the city would pay us $300,000. What happened to that? The school got a dock on the Malden River for the few students who were in crew. Oh, and "preference" for fields for the few students who participate in the sports program. The City only pays $3K a month for that whole station and parking lot. The school has to pay for two office spaces and the staff and equipment necessary to outfit them. More jobs and more bids to be given out. Where is the benefit here to ALL the students?
Oh, and let's not forget about the sub-letting of the wonderful school we occupied in Everett and cost a bundle to outfit. You parents with the younger students really ought to listen and pay attention to how woefully inadequate the High School is on Highland Ave. There is never going to be a gym or anything large enough for the whole high school to assemble. How much will it cost to turn the Davidson property into the field not adequate for the football team and the field house being proposed? More jobs and bids for the select few. All this money being diverted from the students. Doesn't that bother or make you wonder even a little bit? It makes me very uncomfortable when the DOE tells me, "Well, they're not doing anything exactly illegal." Immoral, unusual or unethical sure, but not illegal.
If a teacher gives any kind of notice, they are gone within the hour. No chance to say "good-bye" to the students. They send the kids to a movie in the multi-purpose room while the teacher packs up their stuff and is gone before the kids get back. Yet, they have hired someone without credentials for the position of Public Relations who is making a mockery of the Code of Conduct the students must follow.
So, that is the side where the parents have to stand up and demand better for THEIR school--not the board's school. Certainly not the spot for the opportunistic Ward 6 councillor, either. Make up your mind who you work for.

What I would like to see is how much is the sports program costing to create and maintain and how much money is allocated to say, Drama, the music program or even the school newspaper? Those are also important to the development of a student who perhaps is athletically challenged or not interested.
This story is not about me regardless of how hard you try to make it. It is about how the school is not forthcoming in public information and stonewalled the Globe. They did not conform to the requirements of the DOE for submitting the annual report information until I questioned the board. Remember that one? There is a pattern here of reckless insider deals being made--don't make me laugh about the Roosevelt park deal. Time to share the information like everyone else does.

Moving on. Did you know that this school is required to have site visits from the DOE? Did you also know that whenever these are conducted, the parents who need to be at the school to be interview by the DOE are hand selected by the school? I am sure that I do not even have to tell you who those parents are, because you have probably guessed already. Yup, family members of the board and their relatives who have kids in the school. That school never had any intentions of even allowing special ed into their little empire until parents forced them to do the right thing. The likes of AnnieO's kept this board on their toes. If you are not a board member, to which I believe that you are, then as a parent, you should have known about this. Did you know that teachers have to sign contracts when they are hired stating that they are not allowed to speak to any one should they be fired? That means no speaking to parents or the kids, never mind the media.
I have no regrets removing my children from this school! My children became kids again once they left that horrible place! Missed the teachers and their friends, but they were happy again!

It is very difficult to expel a student from a public school, therefore it isn't possible, nor lawful, to only keep the "cream of the crop". We are aware of the dirty tricks the charter system uses to enforce their behavior code. The public schools must accept their behavior issues, even after the charter school receives the funds from the state for that given child. Instead of "you're kicked out" it's "Well Mr. Smith, there are other choices if you don't like our way of doing things." The public schools inherit the behavior problems, special ed students, homeless children, low performing students, non-english speaking, and what ever else their "lottery" doesn't deem fit in their PUBLIC FUNDED school.

I know of students who have been high up on the wait list for the same grade level as one who has yet to be called. I would be willing to bet that the individual who conducts the lottery is a friend, family member or business associate of the dictator of MV. As for the integrity of the Board members, why are they always the same individuals even though the bylaws of the charter require that they be changed every three years? It is unfortunate that one man has managed to take complete control of an educational institution when he has no formal education or experience within education not does he value the teaching profession (and I am not referring to Dr. McCleary). At the required 'Open Meetings' of the Board why do they go into 'Executive Session' most nights when this is discouraged by the DOE? MV explains this away by stating they have an attorney overseeing the meetings to ensure the bylaws are followed. Is this the same attorney who has his son 'working' at MV? As with other appointed employees (aka Band of Merry Bandits who are overpaid, under worked, and held to very different non-existent standards than the rest), this employee does very little to benefit the students but does run one great pseudo betting game for the staff.
The individuals who are angry and lashing out at MV should not be belittled or criticized as their issues are not with the concept of the school but rather with the corruption and mismanagement of it. The sole purpose of the school should be the students (as stated in the Mission Statement) and as such, all decisions should be to their benefit. Hiring unqualified, unmotivated, inept, or questionable individuals is unacceptable. MV somehow believes that the Charter bylaws, NCLB laws, and our state and federal laws do not apply to them. Everyone should inform themselves by reading not only these documents but also the reports from the DOE's visits.

One relative, after getting into the first lottery, move to NH. Moved back to Malden years later and guess what? All of their kids got back into MV. I asked the wife how that was possible. She told me that she was told by a member of the board to get a pretend Medford address in case anyone questioned how her kids got back into the school. Needless to say, I was not shocked. As we all know, the chairman’s kids and his brother’s kids all got in on the first lottery, so did all of the lower school director’s nieces and nephews, the mayor’s kids. I could go on and on! That is how crooked that lottery was, and I am sure, still is.

This has still not been done yet it has been included as an expense. Check out other districts, I have yet to come across another one that has recruitment expenses such as MV's. One must question why they must spend (if, in fact it is true) so much to recruit employees. I'm sure it has something to do with the fact that experienced educators would not consider working there (their reputation is less than stellar within the education circle) and the high turn over rates. Parents, don't kid yourself, the turnover rate is not as a result of the teachers not living up to the schools expectations. The teacher moral is incredibly low, teachers who truly care about their students are either disgusted with how different kids are handled differently or refuse to play the game. Parents, ask to see a teachers contract, you would find that even though the Anti-Discrimination laws prohibit withholding information from parents, the contracts restrict teachers from advising parents to remove their children from MV - even if they are not receiving the education or support they require as a result of a disability. Any parent of a student who receives special education support should hire an attorney before going into any meeting as parents are frequently denied services for their children even though under NCLB and IDEA the school is REQUIRED to provide an appropriate education for ALL students.
As for Andrew25 - I believe if you read through the numerous comments and take off the blinders you would begin to appreciate the situation for what it is. Yes, the school did do great things initially but things have been getting substantially worse each year. The behavior management is practically non-existent as the students have no fear of the current Assistant Director, the MCAS scores are falling each year (do an analysis, Melrose, Wakefield and Stoneham are now outperforming MV), and they have not achieved AYP in many categories (ESPECIALLY Special Education yet the Director is in no danger of being replaced). I don't think the parents who are commenting on here do not appreciate the strides that the school has made, it seems that they are concerned about the future of the school considering the collision course the school is currently on due to its Administration.

My own personal feelings are that when it now becomes a 13 million dollar deal. The proverb that I list above really starts to hit home with me. But, that's my opinion and when will the lawmakers in our city stop hiding in the shadows or behind fake names on websites?

As for the comment regarding the school living up to its charter and it being viable, etc., the writer obviously has never had dealings with the DOE. Recently a reporter doing an article on the Ogdren case provided insight into the DOE's regulations regarding IEP's. I don't have the exact numbers in front of me but she stated that of 600+ requests for appeals, about 40 were granted a hearing, and of those, only 4 were successful. I've called various departments within the DOE including the PQA, Charter Division, and Special Education department and was less than impressed with the experience. While one would hope that they would hold MV accountable, the sad truth is that they are aware of what is going on there but have no incentive to do anything about it. As someone said earlier, for some students its better than the alternative yet that should not make ANY of it acceptable or tolerated. Andrew25, to your point regarding the busing fee being 200.00, you obviously only have 1 child and you haven't had to pay the fee upfront until MV determines you are eligible for a waiver. As for the reference to IB status, obviously you have never attended or been part of an IB program as the one at MV is severely lacking and not providing the benefits it was meant to. As for the graduating classes success, the classes were small, the turnover minimal, and the school was then under the leadership of Dr. Biegler. That is no longer the case and the students are suffering (except yours).
I saw this quote hanging in MV a few years back and at the time I didn't appreciate the implications. Regardless of whether you are a parent, student, or staff member, don't think it can't be you or your child.

Let me give you some advice. I have some experience in your field of expertise, given that I am a CFO by day and a Medford/Mommy/Wifey by night.
Here is my advice: If someone asks you to do something important, you do it. You do it no matter what it takes. You do it even if you have to stay up until 4 AM getting it done. When you first got the request from the Globe I cannot understand why you did not call the Globe and ask for clarification, or call your peers even in the City of Malden to see what types of data they provided. This type of request is actually substance over form, and you are standing there watering one blade of grass asking yourself why everyone is so upset when you are just the victim. If the Globe wants to see something, and you know it is going to potentially end up on the front page of the paper, you do whatever it takes to deliver what they want in the time frame expected so as to avoid, you know, avoid bad press for the school. Even if you are super busy with budget season. Even if you are working on taking down a bond for the athletic fields. Even if you provide exactly what you think they are asking for. It's the path of least resistance for the organization. And in the end, it is about the organization and not about you. By writing this letter you made it all about you. Which is why everyone is rolling their eyes as it really should be about the school and the kids. You inadvertently stole the spotlight from the school's schievements to your whiney victim rant. You did this to yourself. If you were worth your paycheck you would have forseen this coming and done whateevr it takes to avoid it... even if you are busy and the request is not clear.
By the way, if I provided handwritten payroll records to either my CEO, my Board, or my auditors, and then said the 3rd party payroll company I hired did not provide me what I needed to do my job, I'd be fired. In like 3 minutes or less. Really, handwritten payroll records? Honestly.

You keep telling yourself that all the corruption, preferential treatment, and total disregard for the laws and by-laws of the charter are acceptable because you are providing an education to SOME of your students. Don't worry about the ones you are failing to provide an adequate education to as they were insubstantial from the beginning.

We appreciate that our previous attempts at intimidating those of you who dared to challenge or questioned our decisions, motives, integrity or moral behavior have done little in the way of promoting a positive, productive, forward moving school whose only priority were its students. As such, we have come up with a solution that we believe will not only allow, but encourage those of you who have very valid concern for many of our actions while still allowing those members of our community who have loyally kept on their blinders to continue to do so. From this point further, rather than intimidate, harass, or push our vocal members out, we encourage you to contact the appropriate regarding any and all allegations concerning misconduct, misappropriation of funds, and the breaking of any and all laws or charter bylaws.
To assist you in your sharing of experiences, first-hand observations, and general disgust, we are enclosing a list of government agencies who SHOULD be interested in our wrong-doings. I hope you find this list helpful and complete with all the required information needed to inform the appropriate individuals. In the event the appropriate agencies or individuals do not appear responsive to your concerns, we have also included a list of reporters and news stations that have investigative reporters. While there are many good teachers at the school, there is also a continuing flow of bad ones. This causes the children to flounder in a subject or to not learn it at all. One year, my child had 3 or 4 different teachers in a year for one subject. The school never explains what is going on to the parents and if you dare ask, they envision you as a troublemaker. They don't like when parents speak up for their children. They believe they should never be questioned. They don't understand that it is THEIR (the students) school and not OWNED by the board.

The statements, lies, b.s., and intimidation tactics that the school uses to 'control' the parents are not only unbelievable, but many times illegal under NCLB and IDEA laws. Oceans, give him a few years and he'll be singing a different song. I've found its the parents of their special ed kids that turn fast and hard against the school, and understandably so.
NOTE TO ALL PARENTS OF IEP's/504's----- if you are unable to have an advocate or attorney with you during meetings, do yourself and child a favor and TAPE RECORD THE ENTIRE MEETING. Of course, this is if Queenie and the Fixer (aka Finn) will allow you to do so. I believe it is legally within your right but I can see the use of intimidation tactics or the meeting coming to abrupt halt.

I do know that the State Ethics Committee DOES NOT release the identity of the individual filing the claim. What I did not realize is that while the Dictator clearly is in violation of numerous conflicts, Finn the Fixer (and others) are also considered public figures/employees and are subject to the same ethics and conflict of interest laws. For example, the re-admitting of Fixers two nieces is clearly illegal but also now makes him guilty of breaking the laws (oh Mr. Fixer, it'll be interesting to see you fix this one).
They also made mention of how in situations like this, it usually isn't just one person who would have information or aware of all conflicts or instances of fraud on the part of MV. The different agencies can only investigate what they are aware of, if they are not informed the issues may never be resolved. I would encourage anyone with information that demonstrates the dictators disregard for the laws and by-laws to contact the appropriate agency, ESPECIALLY if you have specifics that can be backed up (such as The Fixer's nieces). With all that is currently going on regarding political corruption and school budgets, state officials are willing to listen - and scared not to! Just remember, the goal is not to destroy MV as they have done some commendable things. The goal is to secure it's future and the future of ALL of their students by demanding it have qualified staff, exceptional leadership, and managed in accordance with the laws and by-laws that govern them (including transparency and accountability). Its time to clean up MV and get the corruption and mismanagement out of there.

Mind you, this is a SAFETY issue and the dictator has his personal crossing guard at the end of his street (who messes up the traffic) and I was previously told by Henry they couldn't move him. No guard was in front of the school in those days on Laurel St. Being the dinosaur Henry is (like the Mayor) he didn't know the difference between a message board and an email properly identifying me. He flipped out completely and lost it and let me have it. I had to sit there and listen to how I was "the lowest of the low" and how he was personally offended that I would accuse him of not moving fast enough (over three months!) to secure a replacement...yell, yell, yell. The rest of the board sat there like mutes and let me take his abuse. No one stood up to stop Henry from looking more and more foolish the more he ranted at me. When I tried to interject he told me to be quiet that he wasn't done yet and I would have to sit there and listen until he was done. Until that moment I have not been a confronter. Henry changed that. I did stand up for myself and he looked like the biggest dope when I was done. The board showed themselves for who they are to me. It makes me wonder if those people who dropped out were influenced by his

We should also (as parents, teachers, community members, reporters, etc) hope that school officials treat parents with respect just as parents should be respectful of school officials. Did anyone else happen to notice that the majority of these individuals are connected somehow to the dictator? As for the PDC's (Mullen & McKinnon), ask them how much 'professional development' either of them offer to their staff. The dictator is the only reason those two are still there. As the individuals that are responsible for the hiring and day to day activities of the teaching staff, they are either clueless as to how to effectively interview and hire competent teachers (or in this case identify who will or will not be a puppet on a string before hiring them) or can't create a positive work environment that encourages communication, provides coaching, and a professional environment. At least the lower grades have managed to create teams that work well together and the teachers stay. The upper grades (4-8) are a joke - the majority of the turnover are these teachers. Love seeing 3 of the dirty dozen (the actual Mo, Larry, and Curly themselves - Sir Slacking, Mr Bets, and MeetMe@theCorner Baglio) actually having to work lately. The dictator must be cracking the whip on them in case the media decides to show up. What about you Andy, are you cracking the whip or having it cracked under you?
Out of curiosity, which board of followers was it that sued the school due to an allergy disagreement? Maybe you?

On an positive note (whether you are the dictator or just one of his followers), I have to believe that when you first became involved in opening the charter school, you had the best of intentions (especially since you made it very clear you could get your kids into any school and didn't need an alternative to Malden schools). It was no easy endeavor and is commendable. Unfortunately, you've let your ego and need for power to lead you astray. Even more unfortunately is that the students (and future students) of MV have and will continue to pay the price, unnecessarily.

Gee, maybe she too works at MV with all of your friends and family members...? It's ok for your group of misfits but not for anyone else? Bit of a double standard there, don't you think? But then again, if all of 'those' kids got in, how would ever manage the ELL students (you know, English Language Learners that MV doesn't seem to have any of) or students who required alternative instructional methods. I must admit, that I feel it is unfortunate and unfair that BY LAW the children of the folks who dedicated themselves to starting the school and ensuring its success are not to be given any special privileges or consideration in admissions. But its the law and if it was just the Administrations children, most people would be hard pressed to fault it (and we all know that that isn't the case). Fraud is fraud and cheating is cheating.
As for the public and parents not knowing or caring about what I'm talking about or who the dictator is, you keep telling yourself that. Parents care as it impacts their child, the public cares as its their tax dollars that are being abused. Besides, prior to 2009 most us hadn't heard or would have cared about Bernie Madoff. His actions were a contributing factor in the changes to financial oversight of brokers. I don't expect that the dictator and his actions will gain the extensive media coverage and sweeping reforms as Madoff prompted but with government corruption being a hot topic these days, he will be exposed. Unfortunately for proponents of Charter schools, his actions will be fuel for the fire for those opposed to the concept. One bad apple...

BTW, love the throwing of insults and names - especially as you call me immature. I've stuck to the facts, so much so in fact, that when I've made a questionable or POSSIBLE inaccurate statement, I correct myself. Oh PR, you keep pushing your propaganda. Too bad none of the schools accomplishments include 'following the laws', 'meeting the educational needs of all students', 'hold ourselves to the highest degree of integrity and ethics', "teaching our children through example and mentoring', and 'only hire the most qualified and competent staff'. Should I continue? I also don't remember seeing athletic accomplishments being mentioned anywhere in the charter of the school. I guess if it was then putting an athletic facility before providing your students with a quality, appropriately sized facility, would be acceptable (or even understandable). Is it true that the school has requested the enrollment cap be listed by 100 students? Must be because of all that extra space you have over there in the Lebanon street facility. Come on PR Guy, give me another of your quotes....they've given us so much insight!
